GAME RULES

GENERAL CONDITIONS FOR PARTICIPATION IN THE GAME

The general rules of participation and the rules of play for the games organised by Matusz-Vad AG and organised on the Öttevényer Schloss site.

 

THE GAME ORGANISER

1. the organiser of the competition (hereinafter: the Game) organised on the website https://ottevenyikastely.hu/ (hereinafter: the Website) is Garzon Plaza Kft. (registered office: 9024 Győr, Vasvári Pál Street 1/B, further contact details under point 6.1.) (hereinafter: the Promoter).

 

CONDITIONS OF PARTICIPATION

2.1 The organiser will announce the individual matches in the posts published on the website (hereinafter: post). The Promoter will always inform the members of the Website in the relevant Post of the duration and specific conditions of the relevant Match. The Promoter organises the following type of game on the Website, so that participation is subject to the following conditions:

The organiser may specify further conditions of participation in the relevant post.

2.2 The terms and conditions of use published on the Website, which also apply to the use of the Website, are also binding on the Games, including, but not limited to, general prohibitions and rules applicable to User Content.

2.3 Only Hungarian citizens who have reached the age of 18, hold a valid identity card issued by the Hungarian authorities and have a place of residence or domicile in Hungary may participate in the Games, provided that they do not fall within the category of persons defined in point 2.9, are capable of acting (hereinafter referred to as "Players") and

• subscribe to the newsletter;
• perform the tasks announced by the organiser in the published post in accordance with the instructions given therein; and
• agrees that the promoter or the organiser may process the personal data provided at the time of registration for the newsletter and during the match in accordance with the provisions set out in the Privacy Policy (Chapter 6) in connection with the match concerned, and
• by participating, accepts all the terms and conditions set out in these rules (hereinafter referred to as the "Rules")

(hereinafter collectively referred to as the 'application').

2.4 A player is entitled to participate in the game with only one application (unless the organiser stipulates otherwise in the relevant post).

2.5 Applications that do not comply with the formal and substantive requirements described in these Rules and the relevant post will be automatically excluded from the game concerned, while valid applications will be sent to the computerised registration. The organiser may exclude from the game concerned players who have provided false data.

2.6 The Promoter will only consider valid the applications submitted by the players themselves for the relevant match. Should the player not use his own Facebook or Instagram profile or his own email address, the Promoter and the Organiser exclude any liability in relation to any dispute arising from the eligibility to use Facebook and Instagram profiles and email accounts.

2.7 By submitting an Application, the Player acknowledges that the content, performance, message and data transmission and response speed of the Games' technical infrastructure are a function of server technology and may be adversely affected by factors beyond the Promoter's control, such as (but not limited to) connection errors, server computer performance, network utilisation, network coverage and maintenance of a secure network connection. The Promoter and the Operator exclude all liability arising from the matters described in this paragraph.

2.8 The Promoter may examine the applications for compliance with the conditions of the Laws of the Game and if, for any reason, they or the player submitting them do not comply with the conditions of the Laws of the Game, the Promoter may exclude the player concerned from the relevant game.

2.9. excluded from the Games are employees of the Organiser, Matusz-Vad Zrt. and other third parties involved in the organisation of the Game, as well as their close relatives within the meaning of paragraph 1 of Section 8:1. (1) of Act V of 2013 to the Civil Code.

2.10. Players who, contrary to the spirit of the Games, participate in a team under the name of a natural person, use a Facebook or Instagram profile that is not real, with the intention of increasing their chances of winning by such deceptive behaviour, may be excluded from the relevant Game or Games at the Promoter's discretion. Such players include.For example, associated persons who coordinate their actions to win prizes and combine the efforts of multiple persons under one name, thereby depriving other players who wish to play fairly of the chance to win. This includes those who enter the games using non-genuine data to unfairly increase their own chances of winning. Participants or players as defined in this paragraph who engage in unfair behaviour shall be liable to compensate the Promoter and/or the Promoter for any damage they have caused in connection with the game.

 

DETERMINATION OF THE WINNERS

3.1 Depending on the game, the Promoter will determine, from among those who have validly registered for the Newsletter during the duration of the relevant game, who will be the winner of the relevant game. The method of selecting the winners will be a random draw.

In the case of a draw: under the supervision of a three-member draw committee appointed by the Promoter, 1 (one) winning application will be drawn by a random mechanical draw. The place of the drawings will be the office of the Promoter (1103 Budapest, Kőér utca 3/A). A record of the drawings will be kept, signed and certified by the members of the committee.

3.2 In each draw, the Promoter will draw a total of 2 (two) alternate winner entries and the alternate winners may be entitled to the relevant prize in accordance with the provisions of clauses 4.3 and 4.4 if the winning entry is invalid for any reason or the winner is disqualified from the relevant draw for any other reason related to his/her entry.

PRIZES, NOTIFICATION OF WINNERS, PRIZE PRESENTATION

4.1 The Organiser will announce the price for the respective Match at the same time as the announcement of the Match in the post (hereinafter: Price). The Price consists of a EUR 4,000 discount, which can be used at any time during the 2024 Wedding Season, selected from the available dates, corresponding to the rental of the Öttevény Castle with a Wedding Planner and will be credited as a discount from the final amount of the invoice. The Promoter reserves the right to modify the prizes during the duration of the relevant game and thereafter, subject to prior notification to the players via the website, and to replace them with other prizes equivalent to the prize in question.

4.2 The prize is non-transferable and cannot be exchanged for cash. A player can only be eligible for 1 prize during the entire duration of a given game, regardless of the number of entries.

4.3 The duration of the competition is until 10 November 2023 and the planned date for the electronic draw is 11 November 2023.

4.4 The Promoter will publish the names of the winners of the prizes no later than 3 (three) working days after the relevant draw or determination of the winner in a comment under the Facebook or Instagram post on the Website associated with the Game to which all players expressly consent by participating in the relevant Game (hereinafter: "Publication"). The winning player is obliged to provide, within 3 (three) working days after the Publication, in a private message to the Website, his/her exact personal data (full name, residential address in Hungary) required for the delivery of the prize, which shall be deemed as acceptance of the prize at the same time. If the winner fails to provide the data required to communicate his/her prize within the above mentioned deadline, the winning player's application will be disqualified and the Promoter will appoint a substitute winner for the prize.

4.5 The Promoter will deliver the prizes to the respective winner for personal collection at the residential address in Hungary specified by the player. The Promoter will make two attempts to deliver the prize within 60 calendar days of the relevant draw/winner being drawn. The winning player is obliged to cooperate in order to deliver the prize in accordance with the applicable General Conditions of Contract of the Courier Service and the CLIX Act of 2012 on Postal Services. If the winner fails to provide such cooperation and the delivery of the prize fails as a result, this circumstance cannot be held against the Promoter or the Executor. The Promoter cannot provide any other means of delivery of the prize.

4.5 The Promoter will exclude from the relevant Match those entries for which the prize cannot be delivered or delivered to the player submitting them because the personal data provided in the entry or after publication is not genuine, incomplete or incorrect, or the player submitting the entry does not comply with the conditions set out in these Rules for any other reason. The Promoter, Executor accepts no responsibility for incorrect data provided by the player.

 

TAXES, COSTS

(5) Any income tax liability associated with the prize is borne by the organiser. The Promoter has no further obligations other than the delivery of the Prize and the settlement of any associated tax consequences. The delivery costs for the Prize are borne by the Promoter. Any other costs that may be incurred are to be borne by the player.

 

PRIVACY NOTICE

6.2 The purpose of the data processing is to enable the data controller to ensure the participation of the player in the competition and to process the personal data of the players in connection with the implementation of the competition and the delivery of the prizes.

6.3 The legal basis for data processing is the express, voluntary and informed consent of the player. By participating in the game, as set out in point 2.3, the player consents to the processing of data. Those who participate in the game expressly agree that the Promoter, as data controller, may process their personal data solely in connection with the game in question, in the implementation of the applications, and for contact management and administration purposes, and, in the event of winning, publish their name on the website without any further conditions or consideration.

6.4 As part of the data processing, the Promoter will process the following data about the player: full name, e-mail address, telephone number, residential address if winning.

6.5 The duration of the data processing shall correspond to the duration of the match in question. In the case of the competition winners, the data of the competition winners will be kept for 5 years after the prizes have been awarded.

6.6 The Organiser will use the assistance of a data processor during the execution of the game. The data processor carries out certain technical operations in connection with the personal data processed. During the Games, the Promoter, as data processor, has access to the player's personal data.

6.7 The Promoter, as data controller, shall process the Player's personal data in accordance with the applicable Hungarian and European legislation, i.e. Act CXII of 2011 on the Right to Information and Freedom of Information, and the provisions of the General Data Protection Regulation (i.e. the GDPR).

6.8 The player as data subject has the following rights in relation to data processing:

6.8.1 Right of access

Under the right of access, the player may at any time request information from the data controller about the processing of his/her personal data, access such information and be informed whether and which personal data the data controller is processing about the player.

6.8.2. Right to rectification, erasure or restriction of processing

The player has the right to request the correction of false, inaccurate or incomplete data by the data controller and may request the deletion of his personal data. If the player requests the restriction of the processing of his personal data, the data controller may restrict the processing in accordance with the request. If the player contests the accuracy of his personal data, the duration of the restriction concerns the period of time that allows the data controller to verify the accuracy of such data. The player may request the restriction of the use of his personal data if the data processing is illegal but the player opposes its deletion. The player may also make such a request if the data controller no longer needs the personal data for the data processing but the player needs the restriction of the data processing for the establishment, exercise or defence of legal claims.

6.8.3 Right to data portability;

Under the right to data portability, the player has the right to receive his/her personal data provided by the data controller in a structured, commonly used, machine-readable format and the right to transmit such data to another data controller without hindrance from the data controller.

6.8.4 Right to withdraw consent

The player may withdraw his consent to the processing of data, in whole or in part, at any time, but the withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal.

6.9 If the player wishes to exercise the rights set out above or if he has any questions regarding the processing of data or if he may have a complaint regarding the processing of data, he may contact the Data Controller by post or e-mail using the contact details provided in point 6.1.

6.10. If the player believes that his/her rights have been violated during the processing of his/her personal data, he/she has the following options:

6.10.1. he or she may contact the data controller directly by post or e-mail;

6.10.3. you may have recourse to the courts if your data have been unlawfully processed or if data security requirements have been breached. you could be entitled to damages and compensation for pain and suffering. information on the jurisdiction and contact details of the courts can be found on the following website: www.birosagok.hu

6.11. Participation in this game and the related data transmission is voluntary. However, if you do not consent to the processing of your personal data, your participation in the game will not be possible. If you request the deletion or restriction of your data or withdraw your consent to data processing during the game or before the prize is awarded, you will be excluded from the game.

 

MIXED PROVISIONS

7.1 The organiser or the performer will not be held responsible for any defects/errors in the applications (e.g. incorrect names, incorrect address, wrong or non-existent data, etc.), for non-delivery or late delivery of the prizes - which are not their responsibility - or for any damage caused during delivery.

7.2 The Promoter does not guarantee the quality of prizes which it has not itself produced or distributed, and if the winner does not collect his prize on time, he cannot claim it from the Promoter or the Executor.

7.3 The Promoter and the Executor disclaim any responsibility for any external so-called SQL attacks on the https://ottevenyikastely.hu/ website or the server that runs it, as well as for attacks or failures of the telephone network. Therefore, if players receive incorrect system messages about their prizes, winner/non-winner status, etc. as a result of an attack on the website, server or network, the Promoter and the Executor will not be held responsible for this.

7.4 The Promoter reserves the right to immediately exclude from the relevant game or games any player who engages in (computer) manipulation, mass email generation, creation of Facebook or Instagram profiles or any behaviour that is incompatible with the spirit of the games or offensive.

7.5 If the player closes the browser window during the data upload or if the connection (for any reason) to the server is interrupted, the organizer and the performer will not be responsible for the loss of the data.

7.6 The Promoter and the Performer accept no responsibility for any failure of the Website due to circumstances beyond their control during which the Website is unavailable or restricted, but they will take all necessary steps immediately to identify and rectify the cause of the problem as soon as possible.

7.7 The provision of data is not for the website but for the organiser.

7.8 The Promoter reserves the right to change the Rules of the Game at any time where justified and the Promoter will publish the relevant information on the Website and make it available to the public with the same publicity as other notices of the Game.

7.9 In the event of a dispute, the competent court shall be the court having its seat and jurisdiction in Győr.
