Commission Contract - Purchase Order -

A private or legal person designated above, hereinafter referred to as the "delegateI hereby instruct Garzonpláza Kft. (registered office: 9028 Győr Vasvári Pál u 1/b. tax number: 13995803-2-08, represented by: Matusz Balázs), hereinafter referred to as the Client (the Client and the Client together: Parties) to bid on my behalf at an auction of works of art under the following conditions until the maximum bidding price specified in the order is reached:

1.        Organisation of the Auction
The Parties stipulate that the Auctioneer, as the Auction House, shall organise the Földváry Castle Art Auction (hereinafter referred to as the "Auction"), during which the Auctioneer, as the seller, shall conclude a sales contract on its own behalf (as owner or trustee) with the highest bidder.

2.        Rules of the Auction
The Parties stipulate that the rules of the Auction are set out in the "Auction Rules" published by the Principal on the web: https://ottevenyikastely.hu/arveresi-szabalyzat/

3.        Mandate to proceed at the Auction
The Principal hereby authorises the Agent to act in its name and on its behalf at the Auction and to bid for the lot specified above, up to the Maximum Bid Price specified.

4.        Lack of remuneration
The Parties stipulate that the Principal shall perform the assignment free of charge and shall not make any financial claims in connection with the performance of the assignment. 

5.        Down payment and deposit
At the time of signing the contract, the Principal shall provide the Principal with an advance payment for the specified auction lots in an amount equal to the starting price 20% by bank transfer to 10400401-50526784-56761011. bank account number. In the subject line, you must indicate the name of the principal and the serial number of the auction lot.  In case of a successful sale, the deposit will be credited as a down payment. This order will expire if the deposit is not paid at the latest 3 working days before the auction.

As soon as we receive the advance payment, we will call you to confirm receipt of the payment and the validity of the order.

6.        Payment obligation
In the event of a successful order, the Client shall proceed in accordance with the Auction Conditions and pay the purchase price, less the deposit, within 5 days of the notification, by bank transfer or in person to the bank account number indicated in Section 5. Purchase Price = Strike Price + 23% Auction Commission, according to the Auction Contract)

7.        Unsuccessful mandate
If another higher bid is received for the auction lot, the Principal shall settle the advance payment within 8 working days and return it in full to the Principal's bank account. In the event of an unsuccessful order for any reason whatsoever, the Principal shall have no claim whatsoever against the Agent.

8.         Notification obligation
Any problems of notification shall not relieve the Client from its obligations under the contract.

9.           Commitment

By paying the deposit specified in point 5 and by completing this form, the Principal irrevocably acknowledges that it accepts each and every point of these Rules, separately and in combination, and that the Principal (https://ottevenyikastely.hu) and has read and accepts the Auction Rules, which it also accepts unconditionally, and shall be binding on itself and on each other.
