General rules for participation and playing in the games organised by Matusz-Vad Zrt. on the Öttevényi castle site

1. The organiser of the Game

The organiser of the prize draw (hereinafter referred to as the "Game") organised on https://ottevenyikastely.hu/ (hereinafter referred to as the "Website") is Garzon Plaza Kft. (registered office: 9024 Győr, Vasvári Pál utca 1/B, further contact details in section 6.1) (hereinafter referred to as the "Promoter").

2. Conditions of participation

2.1 The Promoter will announce each Game in a post on the Website (a "Post"). The Organiser will always inform the members of the Website about the duration and specific conditions of the relevant Game in the relevant Post. The Organiser will announce the following type of Game on the Website, so participation is subject to the following conditions:

2.2 The Games shall also be governed by and be subject to the Terms and Conditions of Use applicable to the use of the Website, as published on the Website, including but not limited to the general prohibitions and regulations applicable to User Content.

2.3 The Games are open only to Hungarian citizens aged 18 years or over, residing or staying in Hungary and holding a valid identity card issued by the Hungarian authorities, who do not fall within the categories of persons specified in Section 2.9, are of legal capacity (hereinafter referred to as the "Player") and who

- subscribe to the newsletter;

- perform the tasks advertised in the Post published by the Organiser as described therein; and

- consent to the processing of personal data provided by the Organizer or the Promoter when subscribing to the newsletter and during the Game, as set out in the Privacy Policy (Chapter 6) in connection with the relevant Game, and

- by participating, you agree to all the terms and conditions set out in these Rules (hereinafter referred to as the "Game Rules")

(hereinafter collectively referred to as the "Application").

2.4 A Player is eligible to participate in the Game with only one Entry (unless otherwise specified by the Promoter in the relevant Post).

2.5 Entries that do not comply with the formal and content requirements described in these Rules and in the relevant Post will be automatically disqualified from the relevant Game, while valid Entries will be computer-recorded. The Promoter may exclude from the relevant Game any Player who provides false information.

2.6 The Promoter will only consider valid those Entries that are submitted by the Players themselves to the relevant Game. If the Player does not register a Facebook or Instagram profile or use an e-mail address or telephone number of his/her own, the Organiser and the Promoter exclude all liability in connection with disputes arising from the right to use a Facebook and Instagram profile and e-mail account in connection with the Games.

2.7 By submitting an Entry, the Player acknowledges that the content, performance, message and data transmission and response speeds of the technical infrastructure of the Games are dependent on the server technology and may be adversely affected by factors beyond the control of the Promoter, such as (but not limited to) connection failure, server computer performance, network congestion, network congestion, coverage and the maintenance of a secure network connection. The Promoter and the Promoter exclude all liability arising from this paragraph.

2.8 The Promoter may examine the Applications for the purpose of fulfilling the terms and conditions of the Rules and, if for any reason they or the Player submitting them do not comply with the terms and conditions of the Rules, may disqualify the Player concerned from the relevant Game.

2.9. Employees of the Organizer, Matusz-Vad Zrt. and other third parties involved in the organization of the Game and close relatives of all such persons as defined in Section 8:1 (1) 1) of Article 8:1 of Act V of 2013 on the Civil Code are excluded from the Games.

2.10. Players who, contrary to the spirit of the Games, participate in a team under the name of a natural person with a fake Facebook or Instagram profile, with the aim of increasing their chances of winning by such deceptive behaviour, may be disqualified from the relevant Game or Games at the discretion of the Promoter. Such players include, for example, persons who associate to participate in sweepstakes, coordinate their actions to win prizes and combine the performances of several persons under one name, thereby depriving other players who wish to play fairly of the chance to win. Such persons shall also include those who participate in the Games with false information for the purpose of unfairly increasing their own chances of winning. Participants or players who engage in unfair conduct as defined in this clause shall be liable to compensate the Promoter and/or the Promoter for any damage caused to them in connection with the Game.

3. Determining the winners

3.1 The Promoter shall determine the winner(s) of the relevant Game from among the valid subscribers to the newsletter during the relevant Game depending on the relevant Game. The winner(s) shall be selected by random draw.

In the event of a draw: in the presence of a three-member draw committee set up by the Promoter, a total of 1 (one) winning Application will be drawn by random (electronic) machine draw. The venue of the draw shall be the premises of the Promoter (1103 Budapest, Kőér utca 3/A).

3.2 The Promoter will draw a total of 2 (two) Reserve Winning Tenders in each draw. The Reserve Winners may be eligible for the relevant Prize as set out in Clauses 4.3 and 4.4 in the event that the Winner's Entry is invalid for any reason or the Winner is disqualified from the relevant Draw for any other reason related to their Entry.

4. Prizes, notification of winners, delivery of prizes

4.1 The Organizer shall publish the prize of the given Game in the Post at the same time as the announcement of the Game (hereinafter referred to as the "Prize"). The object of the Prize shall be a discount of EUR 4,000.00, which may be used at any time during the 2024 wedding season, on a date selected from the available dates, equivalent to the rental of the Öttevényi Castle with the Wedding Organiser and which shall be credited as a discount from the final invoice amount. The Organiser reserves the right to change the Prizes during the duration of the relevant Game, and even afterwards, by notifying the Players in advance via the Website, or to replace them with another prize pool equivalent to the Prize in question.

4.2 The Prize is non-transferable and cannot be redeemed for cash. A Player may only be entitled to 1 Prize for the entire duration of a given Game, regardless of the number of Entries.

4.3 The Sweepstakes will run until 12:00 on 10 November 2023, with the electronic draw scheduled for 11 November 2023 at 10:00.

4.4 The Organizer shall publish the names of the winners of the Prizes on the Website no later than 3 (three) business days after the relevant draw or the determination of the winner in a comment following the Facebook or Instagram post related to the Game, to which all Players expressly consent by participating in the relevant Game (hereinafter referred to as "Publication"). The Winning Player shall provide the exact personal details (full name, address in Hungary) necessary for the delivery of the Prize in a private message sent to the Website within 3 (three) working days following the Publication, which shall also constitute acceptance of the Prize. If the Winner fails to provide the details necessary for the communication of the Prize to the Winner within the above deadline, the Winning Player's Contest shall be disqualified and the Promoter shall select a reserve winner for the Prize.

4.5 The Prizes will be sent by the Promoter, after notification by telephone, by e-mail, electronically to the relevant Winner on the first working day following the draw, to the e-mail address provided by the Player at the time of registration. The Promoter will attempt to deliver the Prize twice, within 60 calendar days of the relevant draw/winner being determined. The Winning Player shall cooperate in order to electronically deliver the Prize, which may be accepted by confirming by e-mail. If the Winner fails to comply with this obligation to cooperate and the prize is therefore not delivered, this circumstance shall not be assessed against the Promoter or the Promoter. The Promoter will not be able to provide another opportunity to collect the Prize.

4.5 The Promoter shall exclude from the relevant Competition any Competition in respect of which the Prize cannot be delivered or transferred to the Player who submitted it because the personal data submitted in the Competition or after its Publication is not true, incomplete or incorrect, or the Player who submitted the Competition does not comply with the conditions set out in these Rules for any other reason. The Organiser, the Promoter and the Promoter shall not be held liable for any loss or damage resulting from the incorrect data provided by the Player.

5. Taxation, costs

The Organiser is liable for any VAT due on the Prize. The Promoter shall have no further obligations other than the delivery of the Prize and the payment of the tax deduction as set out above. The Promoter shall bear the courier costs for the delivery of the Prizes. Any other costs incurred shall be borne by the Player.

6. Information on data management

6.1 The data provided during the Game is handled by the Organizer as the data controller. The contact details of the Data Controller are.

6.2 The purpose of the data processing is to enable the Controller to ensure the participation of the Player in the prize draw, to process the personal data of the Players in connection with the conduct of the prize draw and the delivery of the Prizes.

6.3 The legal basis for data processing is the express, voluntary and informed consent of the Player. By participating in the Game, the Player consents to the processing of the data as set out in Section 2.3. Those who participate in the Game expressly consent to the Organizer, as data controller, processing their personal data solely in connection with the Game, in the course of the conduct of the Contests and for the purposes of contact and administration, and in the event of winning, the Organizer will publish their names on the Website without any further conditions and without any further consideration, solely in connection with the Game.

6.4 In the course of data processing, the Organiser shall process the following data about the Player: full name, e-mail address, telephone number, and, in case of winning, address.

6.5 The duration of the data processing is the duration of the relevant Game. In the case of winning players, the data of the winning players will be kept for 5 years after the delivery of the prizes.

6.6 The Organiser will use the assistance of a Data Processor in the course of the Game. The Data Processor shall perform certain technical operations in relation to the personal data processed. During the Games, the Operator, as a data processor, has access to the Player's personal data.

6.7 The Organizer, as the data controller, shall process the Player's personal data in accordance with the Hungarian and European Union legislation in force, i.e. in accordance with the provisions of Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information and the General Data Protection Regulation (the so-called GDPR).

6.8 The Player, as the data subject of the processing, has the following rights in relation to the processing:

6.8.1. Right of access

Within the framework of the right of access, the Player may at any time request information from the Controller about the processing of his/her personal data, access to such data, and whether and what personal data the Controller processes about the Player.

6.8.2. Right to rectification or erasure, right to restriction of processing

The Player has the right to request that the Data Controller correct or rectify any incorrect, inaccurate or incomplete data, or to request the deletion of his/her personal data. If the Player requests the restriction of the processing of personal data, the Controller may restrict the processing in accordance with the request. Where the Player contests the accuracy of his personal data, the period of restriction shall be for the period of time necessary to allow the Controller to verify the accuracy of those data. The Player may request the restriction of the use of personal data if the processing is unlawful but he opposes its erasure. The Player may also make such a request where the Controller no longer needs his personal data for the purposes of the processing, but the Player requires the restriction of processing in order to establish, exercise or defend legal claims.

6.8.3 Your right to the portability of your data;

Under the right to data portability, the Player is entitled to receive the personal data provided to the Data Controller in a structured, commonly used, machine-readable format and to transmit such data to another Data Controller, even directly, without being prevented from doing so by the Data Controller.

6.8.4. Right to withdraw consent

The Player may withdraw his/her consent to the processing in whole or in part at any time, however, the withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal of consent)

6.9 If the Player wishes to exercise any of the rights set out above or has any questions or complaints regarding the processing of data, he/she may contact the Controller by post or email using the contact details provided in section 6.1.

6.10. If the Player becomes aware of a violation of his/her rights in the processing of his/her personal data, he/she has the following options:

6.10.1. directly to the Data Controller by post or email;

6.10.2. may lodge a complaint with the supervisory authority concerned, i.e. the National Authority for Data Protection and Freedom of Information [NAIH]. The contact details of the NAIH are. Phone: 06-1-391-1400 Email: [email protected]

6.10.3. may take legal action in the event of unlawful processing of your data or breach of data security requirements. The Player may be entitled to damages and compensation for damages. 6.11. Participation in this Game and the provision of data related to participation is voluntary, however, if the Player does not consent to the processing of his/her personal data, his/her participation in the Game is not possible. If the Player requests the deletion or restriction of his/her data during the duration of the Game or before the prize is awarded, or withdraws his/her consent to the processing of his/her data, he/she will be excluded from the Game.

7. Miscellaneous provisions

7.1 The Organizer or the Promoter shall not be liable for any defects/errors in the entries (e.g. misspelling, writing of the address, incorrect or untrue data, etc.), for any failure or delay in delivery of the prizes, or for any damage caused during delivery, which is beyond the control of the Promoter.

7.2 The Organiser does not assume any responsibility for the quality of the prizes not produced or distributed by the Organiser. If the winner does not collect the prize within the time limit, he/she may not claim it from the Organiser or the Promoter.

7.3.The organizer or the operator excludes its liability for any external attacks on the https://ottevenyikastely.hu/ website or the server running it, so-called sql attacks, or attacks on the telephone network, or failures. Therefore, in the event of an attack on the website or the server or the server network, if the Players receive incorrect system messages regarding their prizes, winner/non-winner status, etc., the organiser and the operator shall not be held liable for such cases.

7.4 The Promoter reserves the right to exclude any Player from the relevant Game or Games with immediate effect if it detects or has reasonable grounds to suspect any (computer) manipulation, mass emailing, creation of Facebook or Instagram profiles, or any conduct incompatible with or in any way offensive to the spirit of the Games.

7.5 If the Player closes the browser window while uploading data or if the connection to the server's website is lost (for any reason), the Organizer or the Promoter shall not be liable for any loss of data.

7.6 The organiser or the organiser excludes any liability for any malfunction of the website for reasons beyond its control, during which the website is not or only partially usable, but will immediately take all necessary measures to find the cause of the malfunction and eliminate it.

7.7 The data is not provided to the Website, but to the Promoter.

7.8 The Promoter reserves the right to change the Rules at any time for any reason. The Organiser will publish the relevant information on the website with the same publicity as other announcements of the Game.

7.9 In the event of a dispute, the competent court shall be the court having its seat and jurisdiction in Győr.
